The Court of Appeal on Thursday reinstated the sacked presidential candidate of the Social Democratic Party (SDP), Donald Duke.
Duke who won the SDP presidential primary election was sacked by a Federal High Court in Abuja.
Justice Hussein Baba-Yusuf of the FCT High Court had on 14 December while ruling on the application filed by Prof. Jerry Gana, who came second with 611 votes behind Duke who got 812 votes, declared Gana as the authentic presidential candidate of the SDP in the forthcoming February 16 election.
The High Court judge had noted that the SDP constitution does not allow the presidential candidate to emerge from the same zone with the National Chairman of the party.
Consequently, Justice Baba-Yusuf ordered the Independent National Electoral Commission (INEC) to recognize Prof. Gana as the presidential candidate of the SDP.
